Between Mr. Fouad CHAMI, represented by Mr. Hassan ID BALKASSM, attorney in the Bar Association of Rabat ON THE ONE HAND

The Public Prosecutor’s office ON THE OTHER HAND

FACTS

Considering the introductory request submitted by the plaintiff, through his attorney, to the Office of the Clerk of the Court, the legal fees of which were duly paid on November 16, 2000, in which the plaintiff states that he begot a daughter born on February 9, 1999 in Paris, named Sinimane and that he already submitted a request to register his daughter’s birth in the registers of the Moroccan Registry, but a judgement was passed rejecting his request as the child’s name is not an original Moroccan name.

Actually, the aforesaid name is an Amazigh name, that is a Moroccan name, and therefore, the plaintiff requests the Court to register the child’s name Sinimane in Arabic in the family Record Book for Registration of Births and Deaths, producing the following documents:

Considering the petition of the Public Prosecutor’s office aiming at rejecting the plaintiff’s request as the child’s name has not a traditional Moroccan character.

Whereas the case was considered in many sessions, it was adjourned for deliberation and judgement;

GROUNDS

WITH REGARD TO THE FORM: Whereas the plaintiff’s request aim at registering the birth of the child Sinimane in the Moroccan family Record Book;

Whereas the plaintiff stated in his request that Sinimane is an Amazigh Moroccan name, but he failed to prove that it is an Amazigh name;

The Court considers that Sinimane is not a traditional Moroccan name and therefore it shall be rejected.

Whereas the legal cost shall be paid by the plaintiff;

PRONOUNCEMENT

In accordance with the provisions of the Royal Decree dated 1915 ;

FOR THESE REASONS:

He Court passed the following default judgement in its public session:

With regard to the form: The Court accepts the request and orders the plaintiff to pay the legal costs.

Thus, the Court passed its judgement on the aforesaid date.

There follow an illegible signature and the print of the seal of the Court of First Instance in Rabat.
